These Terms of Service ("Terms") govern your use of NordCheck, a compliance screening platform operated by ASKF (SIREN: 992 495 960), located at 1 rue Marguerin, 75014 Paris, France.

By using NordCheck, you agree to these Terms. If you do not agree, please do not use our services.

2. Our Services

NordCheck provides AI-powered compliance screening services, including sanctions list checking, PEP (Politically Exposed Persons) screening, and adverse media monitoring. Our services are designed to assist with regulatory compliance but do not constitute legal advice.

Professional Use Only: NordCheck is designed for use by businesses and professionals in the context of their regulatory compliance obligations. By using our services, you represent that you are acting in a professional capacity and not as a consumer.

3. Account Registration

You must provide accurate and complete information when creating an account.
You are responsible for maintaining the security of your account credentials.
You must notify us immediately of any unauthorized access to your account.
One account per user/organization unless otherwise agreed.

4. Acceptable Use

You agree NOT to:

Use our services for any unlawful purpose
Attempt to reverse engineer or extract our data sources
Share your account credentials with third parties
Use automated tools to scrape or overload our systems
Resell or redistribute our services without authorization

5. Subscriptions & Payments

Paid plans are billed monthly or annually as selected.
Payments are processed securely via Stripe.
Prices are displayed in EUR and include applicable taxes.
You may cancel your subscription at any time; access continues until the end of the billing period.
Refunds are provided at our discretion for unused portions of annual plans.

6. Free Trial & Credits

New users receive free screening credits. These credits expire after 30 days of inactivity. We reserve the right to modify or discontinue free offerings at any time.

7. Intellectual Property

All content, features, and functionality of NordCheck are owned by ASKF and protected by intellectual property laws. You may not copy, modify, or distribute our platform without permission.

8. Important Service Limitations

Please read this section carefully as it defines the scope of our services.

Not Legal or Compliance Advice: NordCheck is a screening tool, not a legal service. Our results do not constitute legal, regulatory, or compliance advice. You should consult qualified professionals for compliance decisions.
Your Responsibility: You remain solely responsible for your own regulatory compliance obligations. NordCheck assists your due diligence but does not replace it.
Data Sources: Our screening relies on third-party data sources (sanctions lists, PEP databases, media sources). While we strive for accuracy and timeliness, we cannot guarantee these sources are complete, accurate, or up-to-date at all times.
AI Limitations: Our service uses artificial intelligence for analysis. AI systems may produce false positives (flagging non-matches) or false negatives (missing actual matches). Human review of results is essential.
No Guarantee: We do not guarantee that using NordCheck will ensure regulatory compliance or prevent sanctions violations. Screening results are one component of a comprehensive compliance program.

9. Artificial Intelligence Disclosure

Our Service uses artificial intelligence and machine learning technologies ("AI") to analyze screening results and generate risk assessments. By using NordCheck, you acknowledge the following:

Human-in-the-Loop Architecture: NordCheck is designed as an AI-assisted tool, not an autonomous decision-making system. All AI outputs are intended to assist qualified compliance professionals, who retain full authority and responsibility for final compliance decisions. The AI does not make binding determinations on your behalf.
AI Limitations: AI-generated outputs may contain errors, including false positives (incorrectly flagged matches) or false negatives (missed matches). You must not rely solely on AI outputs for compliance decisions without human review and professional judgment.
No Training on Your Data: We do not use your screening data, queries, or results to train, fine-tune, or improve AI models. Your data is processed solely to provide the Service.
Transparency: Upon request, we can provide general information about the AI systems used in our Service, including their purpose and known limitations.

10. Disclaimer of Warranties

NordCheck is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our service will be uninterrupted, error-free, or that defects will be corrected.

11. Limitation of Liability

To the maximum extent permitted by law, ASKF and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or regulatory penalties, arising from your use of or inability to use NordCheck, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claims arising from these Terms or your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.

Exceptions: Nothing in these Terms shall limit or exclude liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; (c) any liability which cannot be limited or excluded by applicable law, including mandatory provisions of French law regarding faute lourde or dol.

12. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the service ceases immediately. You may request export of your data within 30 days of termination.

13. Force Majeure

Neither party shall be liable for any failure or delay in performing their obligations under these Terms if such failure or delay results from circumstances beyond the reasonable control of that party, including but not limited to: natural disasters, war, terrorism, riots, government actions, internet or telecommunications failures, or pandemics.

14. Professional Use & Withdrawal Rights

NordCheck is a B2B (business-to-business) service intended for professional use only. By registering, you confirm that you are acting in your professional capacity and not as a consumer.

Consumer protection notice: If you are a consumer (which would be contrary to our intended use), please be aware that digital services commenced with your prior express consent may not be subject to the 14-day withdrawal right under EU consumer protection law, as the service begins immediately upon your first use. If you believe you have registered in error as a consumer, please contact us immediately.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the platform at least 30 days before they take effect. Continued use after changes constitutes acceptance.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Governing Law

These Terms are governed by French law. For professional users, any disputes shall be submitted to the exclusive jurisdiction of the courts of Paris, France.
